Current Article 9 Forms (for all jurisdictions except New York and Puerto Rico):
The 2010 Article 9 Amendments are effective in all states, the District of Columbia and in Puerto Rico. With the exception of New York and Puerto Rico, all jurisdictions now accept the new (“current”) Article 9 forms. - UCC1 – Initial financing statement. An official form which contains the names and addresses of the debtor and secured party and a description of the collateral. A creditor files a Financing Statement to provide public notice of a security interest for the purpose of perfecting the interest.
- UCC1 Addendum – Always use the addendum form for fixture/real-estate-related filings, when you have up to two additional debtors or one additional secured party or when you want to designate an assignor secured party.
- UCC1AP – Use this Additional Party form to list up to three additional debtors and up to two additional secured parties on a UCC1.
- UCC3 – Amendment form. A broad term which refers to a filing made subsequent to the UCC1 Financing Statement which amends details about the original record, such as changes to secured party name or address, debtor name or address, collateral information, etc
- UCC3 Addendum – Always use this addendum when amending fixture/real-estate-related filings.
- UCC3AP – Use this Additional Party form to list up to three additional debtors and up to two additional secured parties on an amendment filing.
- UCC5 Information Statement (formerly called “Statement of Claim” and, in some states, “Correction Statement”) – DO NOT USE THIS FORM TO AMEND. The filing of this statement does not affect the effectiveness of an initial financing statement or other filed record. An “information only” form that a debtor or secured party can file to make a note in the public record to inform searchers that a record is either a) inaccurate b) wrongly filed or c) filed by a personal not entitled to do so. A UCC5/Information Statement has no legal effect on the Financing Statement and does not amend the UCC record.
- UCC11 – Finance statement search request form recognized in many states under Revised Article 9 of the Uniform Commercial Code as the form required by filing offices to request a search of their records for UCC filings on a particular party
Current Revised Article 9 Forms for Use in New York:
- UCC1 – Initial financing statement. An official form which contains the names and addresses of the debtor and secured party and a description of the collateral. A creditor files a Financing Statement to provide public notice of a security interest for the purpose of perfecting the interest.
- UCC1 Addendum – Always use the addendum form for fixture/real-estate-related filings and when you want to indicate special debtor types (such as Trusts and Transmitting Utilities) or special transactions (Public Finance, Manufactured Home). You can also use the UCC1 Addendum when you have up to two additional debtors or one additional secured party, or when you want to designate an assignor secured party.
- UCC1AP – Use this Additional Party form to list up to three additional debtors and up to two additional secured parties on a UCC1.
- Co-op Addendum Form (NY) – Use this addendum when filing a co-op UCC so that your filing will be in effect for 50 years.
- UCC3 – Amendment form. A broad term which refers to a filing made subsequent to the UCC1 Financing Statement which amends details about the original record, such as changes to secured party name or address, debtor name or address, collateral information, etc
- UCC3 Addendum – Always use this addendum when amending fixture/real-estate-related filings.
- UCC3AP – Use this Additional Party form to list up to three additional debtors and up to two additional secured parties on an amendment filing.
- UCC5 Statement of Claim (formerly called “Correction Statement”) – DO NOT USE THIS FORM TO AMEND. Current UCC1 Form for Use in Florida:
- UCC1 – State of Florida Uniform Commercial Code Financing Statement Form. Initial financing statement. An official form which contains the names and addresses of the debtor and secured party and a description of the collateral. A creditor files a Financing Statement to provide public notice of a security interest for the purpose of perfecting the interest. Florida requires the additional information in section 6 regarding the Florida Documentary Stamp Tax.
